Florida Summary Administration

What is Summary Administration in Florida?

Summary Administration is an expedited, simplified form of probate in Florida designed for smaller estates or those where the decedent has been deceased for more than two years. Unlike formal probate, this process does not require the appointment of a Personal Representative, allowing for a faster and more cost-effective distribution of assets directly to beneficiaries.

Qualifications for Summary Administration

To qualify for this streamlined process under Florida Statutes, the estate must meet one of the following two criteria:

  • Estate Value: The total value of the decedent’s non-exempt Florida assets must be $75,000 or less.

  • Time Elapsed: The decedent has been deceased for more than two years, regardless of the estate's total value.

Benefits of Choosing Summary Administration

  • Speed: While formal probate can take a year or more, Summary Administration can be completed in weeks or a few months.

  • Simplicity: There is no requirement to appoint a Personal Representative (executor) and issue "Letters of Administration."

  • Lower Costs: Fewer court filings and reduced legal complexities lead to significant savings on administrative expenses.

  • Direct Distribution: The court issues an "Order of Summary Administration," which serves as the legal authority to transfer assets immediately to the rightful heirs.

Why You Need a Florida Probate Attorney

While Summary Administration is "simplified," it is not "automatic." The court requires precise legal filings, including the Petition for Summary Administration. Errors in classifying assets (exempt vs. non-exempt) or failing to properly notify known creditors, if any, can cause the judge to deny your petition.

Our firm ensures that:

  • Your petition accurately reflects Florida’s complex Homestead laws.

  • All potential creditor claims are addressed to prevent future liability.

  • The Order of Summary Administration and any additional Orders that grant the transfer of assets are drafted correctly and with precision so financial institutions and title companies accept them immediately.
